US Govt. for Refusing Habeas Corpus for Cuban FighterHavana, Apr 27. -The US Government urged to reject an habeas corpus request on behalf of anti-terrorist Cuban fighter Gerardo Hernandez Nordelo, who has been held in US prisons for nearly 13 years now.

  This government call implies not granting him a hearing to examine his arguments and the alleged evidence presented against him, which proves again the double standard applied by the White House in its alleged war on terror.

The petition against Hernandez, serving two life sentences plus 15 years in prison, is contained in a 123-page document and three attached papers given to the federal court of Miami by attorney Caroline Heck Miller, the main prosecuting attorney of Hernandez Nordelo, Antonio Guerrero Rodriguez, Ramon Labanino Salazar, Fernando Gonzalez Llort and Rene Gonzalez Sehwerert, also known as The Cuban Five, sentenced in 2001 in a trial full of irregularities held in Miami.

Curiously enough, Heck Miller, who expresses in the text the official White House stand regarding the case, was the one who refused to try Luis Posada Carriles as terrorist in 2005.

Gerardoâ�Ös defense team will answer this petition soon and Judge Joan Lenard will issue her ruling, according to website Antiterroristas.cu.

The Cuban Five are serving unfair, harsh sentences in US federal prisons since their arrest on September 12, 1998 while they were in fact preventing terrorist actions against Cuba.

Though Antonio, Ramon and Fernando were re-sentenced in October-December 2009 in the same district court of Miami, unjustice towards all of them persists.

More than 10 Nobel Prize laureates have demanded their release, being the latest of them former US President James Carter, who described their imprisonment as senseless during his visit to Cuba in late March.

However, President Barack Obama, also a Nobel Peace Prize winner in 2009, has ignored the worlod clamour for their release and keeps them in prison, even though, as a lawyer himself, he is aware that he can withdraw the false accusations against The Cuban Five and grant them freedom. (Prensa Latina)
